In the relevant letter sent by the General Directorate of Domestic Trade of the Ministry of Commerce;
“On August 31, 2023, the Regulation on Real Estate Trade was amended and the obligation to verify identity and authority was imposed on real or legal persons who provide electronic media for advertisements for the sale of real estate belonging to others, and the said regulations entered into force on November 1, 2023.
This In this context, in the first stage, the identity verification of real or legal persons who want to advertise real estate has started to be made through the Electronic Advertisement Verification System (EİDS) established within our Ministry with the integration of advertisement platforms. However, as the second stage, as stated in the Regulation, before publishing the announcement, it is necessary to verify that the real estate subject to the announcement belongs to the member who posted the announcement, or, if this member is a real person, to his/her first and second degree blood relatives or spouse, or that the member who placed the announcement is authorized by the owner of the real estate subject to the announcement.
Regarding the authorization verification process in question, our Ministry uses the General Directorate of Land Registry and Cadastre to determine the owner of the real estate; For kinship determination, joint studies were carried out with the General Directorate of Population and Citizenship Affairs and system developments and integrations for the process were completed; As a result of the aforementioned studies, the technical studies carried out by the units of our Ministry and the E-Government Gateway Integration Unit have come to an end.
In this context, an authorization screen has been created in E-Government, and on this screen;
- Malikin Listing of immovable properties belonging to him/her if he/she is a real person, or to the legal entity of which he/she is the authorized representative if he/she is a legal person,
- Ability of the owner/authorized representative to choose the immovable property that he/she wants to subject to the announcement,
- After selection of the immovable property. Based on the Real Estate Trade Information System (TTBS) records, the authorization process can be carried out after selecting the licensed real estate business that will make the announcement (desired to be authorized) - by determining the authorization period. It is planned to authorize only real estate businesses with an authorization certificate, and if the application is put into effect, real estate businesses without an authorization certificate will not be able to post advertisements. It is of utmost importance that they obtain an authorization certificate immediately to ensure that they do not experience problems and are not subject to administrative sanctions, and I request that your members who are engaged in real estate trade be informed immediately about the above-mentioned issues.
