As is known, the Advertising Board, secretariat of which is responsible for regulating and supervising commercial advertisements published in all media and commercial practices aimed at consumers, is vested with the authority and duty of our General Directorate within the scope of Law No. 6502 on Consumer Protection. In this context, compliance with relevant legislative provisions in advertisements and commercial practices, which are highly influential in determining consumers" shopping preferences, is crucial for protecting the economic interests of consumers, which is the primary objective of Law No. 6502. Furthermore, commercial advertisements, outlined in the general framework of Law No. 6502 and the Commercial Advertisement and Unfair Commercial Practices Regulation prepared based on this Law, must also comply with the advertising-related provisions contained in the specific regulations and other relevant matters applicable to the advertised goods or services. Recently, "mystery boxes" and similar sales methods, consisting of products with unknown contents, have become increasingly common on the internet, particularly on e-commerce platforms. Following complaints submitted to our Ministry and subsequent investigations initiated ex officio, the Advertising Board decided to impose administrative sanctions on sellers operating on certain e-commerce platforms at its meeting dated September 11, 2025, and numbered 361.

The investigations subject to the administrative sanctions concluded that:

- These types of promotions, which do not include any clear information about the box"s contents, could significantly disrupt consumers" economic behavior and could lead consumers to become parties to a consumer transaction to which they would not normally be a party.

- Due to uncertainties regarding the content of the goods or services subject to distance selling, "mystery boxes" and similar sales methods constitute unfair commercial practices through advertising.

In this context, in accordance with Article 172 of the Constitution, which states, "The State shall take protective and informative measures for consumers and shall encourage consumers" self-protective initiatives," it is crucial that your Assembly members are informed about the aforementioned issues regarding commercial advertising and unfair commercial practices and that they exercise due diligence, both to protect the interests of consumers and prevent potential grievances they may experience, and to establish an honest and fair commercial life by preventing unfair competition.
